Swaps, Sales, and What the Heck Is a Cy Pres Action?
This year, CLCC has heard more questions than ever from land trusts about when—and whether—they can swap, sell, or otherwise divest land they own. Others are seeking clarity on what would happen to their conserved properties if a future board decides to dissolve the organization, and how to put effective “backstops” in place through articles of incorporation, conservation easements, or restrictive covenants. This session will demystify cy pres actions, outline best practices for evaluating potential transfers, and walk through tools to ensure your lands remain protected no matter what the future brings. Perfect for board members and staff navigating both today’s decisions and tomorrow’s uncertainties.
